The Jewellery Edit is an independent, UK-based jewellery brand, specialising in timeless, quality gold pieces.
Terms of service
1. Who we are
This website is operated by The Jewellery Edit, a trading name of Muted Luxe Ltd, a company registered in England and Wales under company number 15579634, with its registered office at 28 Fleeman Grove, West Bridgford, Nottingham, NG2 5BH.
In these terms, "we", "us" and "our" mean Muted Luxe Ltd trading as The Jewellery Edit, and "you" means the person using this website or placing an order. Our full contact details are at the end of this page.
2. About these terms
These terms, together with our Privacy Policy, Return and Refund Policy and Shipping Policy, apply to your use of this website and to any order you place with us. Please read them before ordering. By using this website you accept these terms.
Nothing in these terms affects your legal rights as a consumer. If any part of these terms conflicts with your statutory rights, your statutory rights take priority.
3. Using this website
You must be at least 18 years old to place an order with us. You may use this website for your own personal, non-commercial use. Our products are sold for personal use and not for commercial resale.
If you create an account, you are responsible for keeping your login details secure and for activity that takes place under your account. Please tell us promptly if you think someone else has access to it.
4. Our products
We have made every effort to describe and photograph our pieces accurately. Colours and finishes can look slightly different on different screens, so images are an indication rather than a guarantee of exact appearance.
Product descriptions, materials and specifications are set out on each product page. We may change or discontinue products at any time, and we may limit the quantity available to any one customer.
5. Placing an order
When you place an order you are making an offer to buy. Your order is accepted, and a contract is formed between us, when we send you an email confirming that your order has been dispatched, not when you receive the automatic order acknowledgement.
We may decline an order, for example if the item is out of stock, if there has been a pricing or description error, or if we are unable to take payment. If we decline your order we will tell you and refund any payment taken in full.
If you need to change or cancel an order, email us as soon as possible and we will do what we can, though we may already have dispatched it. Your cancellation rights under section 8 are unaffected.
6. Prices and payment
Prices are shown in pounds sterling and include any applicable taxes. The price you pay is the price displayed at the time you place your order, and it is confirmed in your order confirmation email.
Delivery charges are shown separately at checkout and are set out in our Shipping Policy. We may change prices, run promotions and end them at any time; changes do not affect orders we have already accepted.
Occasionally an item may be listed at an incorrect price. If the correct price is higher than the price shown, we will contact you before dispatch and you can confirm the order at the correct price or cancel it for a full refund.
7. Delivery
We currently deliver within the United Kingdom only. Delivery options, costs and timescales are set out in our Shipping Policy.
Delivery times are estimates. Where we give an estimated delivery date, we will deliver within a reasonable time and in any event within 30 days of order acceptance unless we have agreed otherwise with you. The goods become your responsibility once they are delivered to the address you gave us.
8. Cancelling, returning and refunds
If you are a consumer, you have a legal right under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 to cancel your order within 14 days of receiving it, without giving a reason, and a further 14 days to return the goods to us. Where you cancel under those regulations we will refund the price you paid together with the standard delivery cost of your original order.
Our own returns window is longer and sits alongside that legal right. Full details of how to return an item, who pays return postage, and how refunds are processed are in our Return and Refund Policy, which forms part of these terms.
9. If something is faulty
Under the Consumer Rights Act 2015, goods we supply must be of satisfactory quality, fit for purpose and as described. If they are not, you may be entitled to a repair, a replacement, or a refund, depending on the circumstances and how long you have had the item.
If an item arrives faulty, damaged in transit, or is not what you ordered, please email us straight away and we will put it right. We cover return postage in those cases. These rights are in addition to, and not affected by, our returns policy.
10. Our responsibility to you
If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable.
We do not exclude or limit our liability to you in any way where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the goods, including the right to receive goods that are as described, of satisfactory quality and fit for purpose; and for defective products under the Consumer Protection Act 1987.
We supply our products for domestic and private use. If you use them for any commercial or business purpose, we will have no liability to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
This website is provided as it is. We take reasonable care to keep it accurate and available, but we do not guarantee that it will always be available or free from errors.
11. Events outside our control
We are not responsible for delays or failures caused by events outside our reasonable control, such as postal disruption, extreme weather or supplier failure. If such an event occurs we will contact you as soon as possible and take steps to reduce the delay. If the delay is substantial you may contact us to cancel the affected order and receive a refund for anything you have paid for but not received.
12. Reviews, feedback and anything you send us
If you send us reviews, photographs, suggestions or other content, you confirm that it is yours to share and that it is not unlawful, offensive or in breach of anyone else's rights.
You keep ownership of what you send. You give us permission to use, reproduce and display it in connection with our business, including on our website and social media, free of charge. Tell us if you would like us to stop using something you have sent and we will do so within a reasonable time. We are not obliged to publish, keep confidential, pay for or respond to anything you send, and we may remove content that we reasonably consider inappropriate.
13. Things you must not do
You must not use this website unlawfully or in a way that could damage it or interfere with anyone else's use of it. In particular, you must not introduce viruses or other malicious code, attempt to gain unauthorised access to it, scrape or harvest data from it, impersonate anyone, or use it to send unsolicited marketing.
We may suspend or withdraw access to the website, or to an account, if you break these terms. Where it is reasonable to do so we will let you know first.
14. Intellectual property
All content on this website, including text, photographs, product images, graphics, video and the design and arrangement of the site, belongs to us or our licensors and is protected by copyright, trade mark and other intellectual property laws in the UK and internationally.
You may view, download and print pages for your own personal use. You must not otherwise copy, reproduce, republish, distribute or commercially exploit any part of the site without our written permission. "The Jewellery Edit" and our logo are our trade marks and must not be used without our permission.
15. Links and third-party tools
Our website may link to other websites, or give you access to tools provided by third parties. We do not control them and are not responsible for their content, their products or their privacy practices. Those tools are provided as they are, without any warranty from us, and your use of them is subject to that third party's own terms.
16. Our relationship with Shopify
This store is powered by Shopify, which enables us to provide this website and its services to you. However, any sale or purchase you make in our store is made directly with us. By using this website you acknowledge and agree that Shopify is not responsible for any aspect of any sale between you and us, including any injury, damage or loss resulting from products purchased. You release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with us.
Because this website is hosted by Shopify, Shopify collects and processes personal information about your access to and use of it in order to provide and improve the service. Information you submit will be transmitted to and shared with Shopify and third parties who may be located outside the United Kingdom. See our Privacy Policy for details, and Shopify's Consumer Privacy Policy for how Shopify uses your information.
17. Privacy
We handle your personal information in accordance with our Privacy Policy. For the purposes of UK data protection law we are the data controller of the personal information you give us.
18. Changes to these terms
We may update these terms from time to time, for example to reflect changes in the law or in how we operate. The version published on this page at the time you place an order is the version that applies to that order.
19. Complaints and disputes
If something has gone wrong, please email us first, as most things are quickest to resolve directly. If we cannot resolve it between us, you may be able to use an alternative dispute resolution scheme, and you can also take a claim to the courts.
20. General
- If any part of these terms is found to be unlawful or unenforceable, the rest of them continue to apply.
- If we do not insist that you do something you are required to do under these terms, or if we delay in taking steps against you, that does not mean we have given up our right to do so later.
- We may transfer our rights and obligations under these terms to another organisation. We will tell you if that happens and it will not affect your rights. You may only transfer your rights or obligations to someone else if we agree in writing.
- This contract is between you and us. No other person has any right to enforce it.
- These terms, together with the policies referred to in them, form the whole agreement between us about your use of this website and any order you place.
21. Governing law
These terms are governed by the law of England and Wales, and any dispute may be brought in the courts of England and Wales. If you live in Scotland or Northern Ireland, you may also bring proceedings in the courts of the country you live in.
